Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of Smoking-Hub.com, its account and community features, and related services operated by Smoking Marketing Ltd. under the Smoking Hub and Cigar Deal Hunters names (together, the “Service”).

By registering an account or using the Service after being given a reasonable opportunity to review these Terms, you agree to them to the extent permitted by applicable law. If you do not agree, do not use the Service. Our Privacy Policy explains how we handle personal data; agreeing to these Terms does not itself provide consent to optional marketing or tracking.

In these Terms, “we,” “us,” and “our” mean Smoking Marketing Ltd. Communities hosted on third-party platforms are also subject to those platforms’ terms and privacy practices. These Terms apply to our operation of those communities only to the extent relevant and enforceable.

2. Eligibility

You must be at least 21 years old, or the higher minimum age applicable to your use of the Service in your jurisdiction. This is our access requirement and does not mean that every jurisdiction legally requires users to be 21 to read tobacco-related content.

You must not use the Service where doing so would be unlawful. Promotions, rewards, and retailer offers may have additional age, residency, or eligibility restrictions. We may restrict participation or request proportionate eligibility verification where necessary.

These requirements do not transfer our own legal obligations to users.

3. What the Service provides

The Service provides deal information, editorial content, a community forum, user submissions, and related features concerning cigars, tobacco products, accessories, and other topics covered on the website.

We do not sell tobacco products or process retailer purchases through the Service. Retailers are responsible for their own sales, payment processing, age verification, shipping, returns, and warranties. We do not operate a marketplace for members to buy, sell, trade, or privately distribute tobacco products. A “Request a Deal” post requests help finding a retailer offer; it does not authorize a transaction between members.

Community contributions express their authors’ views. Their presence on the Service does not mean that we endorse or have independently verified every statement.

4. Deals, price information, and labels

We make reasonable efforts to keep our editorial deal information accurate. Prices, quantities, coupon codes, membership requirements, stock, shipping charges, taxes, and retailer restrictions can change without notice. A retailer may correct an error, decline an order, or withdraw an offer.

Historical information reflects the products, sources, periods, and conditions we have actually recorded. It is not a complete record of every retailer or transaction. Unless a post expressly says otherwise, prices exclude shipping and taxes, and any stated membership or coupon conditions apply.

These labels do not guarantee the lowest price anywhere or future savings. Different pack sizes, variants, memberships, coupon combinations, and shipping terms may prevent a direct comparison.

Member posts, comments, votes, and “expired” or “back in stock” reports may appear before a team member has checked them. A review statement on an editorial deal applies to that review at that time, not to every contribution on the Service. Saving a deal, receiving an alert, or seeing an active status does not reserve stock or a price.

Verify the final product, quantity, price, restrictions, and transaction terms with the retailer before purchasing.

5. Affiliate relationships and commercial visibility

We may earn a commission when you follow an affiliate link and make a qualifying purchase, at no additional cost to you.

Automatic conversion of community links. We may use automated tools to convert eligible links posted by users in forum topics, comments, deal submissions, and other community content into affiliate links. This may involve adding or replacing affiliate tracking parameters or routing links through an affiliate network. If you follow a converted link and make a qualifying purchase, Smoking Marketing Ltd. may earn a commission at no additional cost to you.

Automatic conversion does not, by itself, mean that the contributor is sponsored by the linked retailer or receives a commission. Contributors must still disclose any separate commercial connection as required by section 9. Our Privacy Policy explains associated tracking and your privacy choices.

We may edit, expire, remove, or limit the distribution of a deal for accuracy, availability, legal, editorial, or commercial reasons. This does not authorize misleading claims or suppression of lawful consumer reviews simply because they are unfavorable.

Retailers and affiliate networks have their own terms and privacy policies. Our disclaimers about them do not exclude responsibility that the law places on us for our own conduct.

6. Accounts, profiles, and restricted access

Provide accurate registration information and keep your credentials secure. Notify us promptly if you suspect unauthorized use. You are responsible for your own use of an account and for reasonably protecting access to it; you are not automatically responsible for every unauthorized act by another person.

Do not impersonate anyone, share or sell an account, or create multiple accounts to evade restrictions or manipulate participation. Unless we approve otherwise, use one personal account for points and rewards.

Some features or deals may be public, available only to logged-in members, or limited to a tier such as Apex Hunter. Access does not establish ownership, a permanent entitlement, or a promise that a feature will remain available indefinitely. Restrictions on reproducing members-only material do not make it confidential or guarantee that other members cannot copy it.

7. Submitting posts, images, and other content

“User Content” includes forum topics, comments, deal submissions, requests, reviews, profile text, photographs, screenshots, and other material you submit.

You retain the rights you hold in your User Content. You must have the rights, permissions, or other lawful basis needed to submit it and allow the uses described below. Being able to find something online, crediting its creator, or owning a pictured product does not by itself give you permission to copy someone else’s work.

Do not upload entire articles, reviews, product photographs, videos, or other protected works without permission or an applicable legal exception. Use links, your own descriptions, or appropriately limited quotations where lawful. Do not remove rights notices or watermarks without authorization.

Remove unnecessary personal information from receipts, order confirmations, and screenshots before posting, including addresses, payment information, account identifiers, and private messages. Do not disclose another person’s private information without a lawful basis.

8. Permission to operate and share your contributions

By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute it as reasonably necessary to operate the Service, and to format, resize, or make technical adaptations for that purpose. We may allow service providers working for us to exercise these rights only as needed to provide their services.

This permission includes converting eligible links in your User Content into affiliate links as described in section 5. Such conversion must not be used to misrepresent your views. Agreeing to these Terms does not itself provide consent to optional cookies or other tracking.

For content you intentionally publish publicly on the Service, this license also allows us to feature the contribution, or a reasonable excerpt with your displayed username, in our own deal roundups, newsletters, and official community channels to share the underlying discussion or deal. We will not use editing to misrepresent your meaning.

The public-sharing permission does not apply to private support messages, private account settings, or nonpublic lists. It does not grant us rights that you do not have, or replace any separate legal basis needed to process personal data.

When content is deleted, we stop new public uses under this license and remove copies we control where reasonably practicable, subject to applicable law. Copies may remain temporarily in backups, lawfully retained dispute records, already-delivered communications, or other members’ lawful quotations. These provisions do not override privacy or erasure rights, or allow indefinite publication of identifiable content merely because it was once posted.

We do not acquire rights to material posted only on another platform merely because its author later visits or registers with us.

9. Community standards

You must not:

• post unlawful material, threats, targeted harassment, defamatory factual claims, or private personal information;
• infringe copyright, trademark, privacy, or other third-party rights;
• impersonate a member, retailer, manufacturer, or team member;
• submit fabricated experiences, misleading prices, undisclosed advertising, spam, or deceptive reviews;
• manipulate votes, reports, points, referrals, rankings, or reward eligibility using bots, duplicate accounts, purchased engagement, or coordinated abuse;
• obtain or distribute restricted coupon codes through fraud or other unlawful means;
• post malware, phishing links, stolen credentials, or instructions intended to compromise an account or system;
• solicit prohibited member-to-member tobacco transactions or circumvent age or location restrictions;
• evade a suspension or misuse reporting procedures to silence lawful criticism.

Retailers, employees, ambassadors, affiliates, and people receiving a relevant benefit must clearly disclose that connection when making promotional contributions. Personal commercial promotion requires our permission and any required disclosure.

Respectful disagreement, legitimate price comparisons, and honest negative experiences are permitted. They are not violations merely because they concern one of our partners. Rewards must not be conditioned on a positive review or on withholding criticism.

10. Moderation, reports, and review

We may review, edit for rule compliance, move, label, restrict, or remove contributions and may warn, suspend, or terminate accounts for violations, security risks, or other legitimate and proportionate reasons. Responses take account of the nature, severity, context, and repetition of the conduct. We do not promise that every submission is reviewed before publication or that every violation will be detected.

Automated tools may assist with spam detection, rate limits, and other administrative tasks. Members can request human review of a moderation decision by emailing admin@smoking-hub.com with the relevant URL, account name, decision, and explanation.

To report allegedly illegal content, use an available reporting feature or email admin@smoking-hub.com. Provide the exact URL, a clear explanation, relevant evidence, your name and email where required, and confirmation that your report is accurate to the best of your knowledge.

We assess reports promptly and fairly and provide acknowledgments, decision information, reasons for restrictions, and information about available redress where required by law. Information may be withheld where disclosure is legally prohibited or a lawful exception applies. Copyright reports and requests to review their outcome follow section 16 of these Terms.

11. Points, badges, ranks, and community status

Points, badges, levels, leaderboards, and statuses such as Apex Hunter recognize participation or provide specified access benefits. They are not money, deposits, investments, or transferable property. Unless a particular published offer expressly states otherwise, they cannot be purchased, sold, transferred, or redeemed for cash or products.

A points balance or leaderboard position alone does not guarantee a prize, paid role, retailer benefit, or permanent access. Any reward based on participation is governed by the published rules for that program or period.

We may correct errors, recalculate scores, reverse points associated with removed or invalid activity, and investigate suspected manipulation. We may change earning rules or discontinue a feature for legitimate operational or legal reasons. Material changes will be communicated appropriately and ordinarily apply prospectively. Changes do not remove rewards already validly earned under an applicable offer, except where its rules and applicable law allow this, such as verified fraud or an actual calculation error.

12. Rewards, giveaways, and ambassador activities

Each promotion or reward program must have its own published rules identifying the organizer, eligibility, entry or participation requirements, relevant dates and time zone, selection method, reward, notification and claim deadlines, and any sponsor’s role.

Those specific rules control the relevant promotion. General membership does not automatically enter you into a giveaway or guarantee a monthly reward. A discretionary community recognition program and a random prize drawing may have different rules.

Chance-based promotions must not require a purchase or a payment for a chance to win. Any tobacco-related prize or reward may be offered only where its specific structure, product, distribution, and eligibility have been confirmed lawful; these Terms do not authorize an otherwise prohibited promotion.

We may require proportionate verification before delivering a reward. A substitute, redraw, disqualification, or cancellation must follow the published rules and applicable law. Recipients are responsible for their own applicable taxes; we remain responsible for any reporting or withholding obligations imposed on us.

13. Saved deals, requests, and notifications

Wishlists, saved deals, deal requests, and alerts help organize your activity. We do not promise to locate a requested item, maintain a saved offer, or deliver an alert before stock or a promotion ends.

Emails, browser push notifications, and on-site notifications may be delayed or affected by device, browser, provider, or network settings. Marketing subscriptions and push permissions are separate choices. Necessary account and security messages may still be sent while an account remains active.

The Privacy Policy explains the data associated with these features and how to change your choices.

14. Our intellectual property and permitted use

We or our licensors retain the rights we hold in our original editorial content, software, design, and branding. We also reserve any copyright and database rights in our curated deal collections and price-history databases, including their original selection and arrangement and any qualifying investment in obtaining, verifying, or presenting their contents. These rights apply only to the extent recognized by applicable law.

User Content and third-party names, images, and trademarks remain subject to their respective owners’ rights. We do not claim exclusive ownership of individual facts, prices, product names, general ideas, or generic presentation methods. This does not authorize copying protected compilations or using the Service in breach of section 15.

You may browse the Service, use its sharing functions, and link to its pages lawfully. Do not misleadingly imply our endorsement or reproduce protected material commercially without permission or another legal right. These Terms do not remove statutory quotation, fair-use, interoperability, or other rights that cannot lawfully be restricted.

15. Automated access, database use, and technical misuse

Except as expressly permitted below, by our prior written permission, or by applicable law, you must not, directly or through another person or service:

• use bots, scrapers, crawlers, browser automation, AI agents, or similar tools to collect content or data from the Service in bulk or on a systematic basis;
• copy, export, mirror, distribute, or reuse all or a substantial part of our deal, coupon code collections or price-history databases, including associated comparisons, classifications, and editorial assessments;
• repeatedly collect smaller portions in a way that cumulatively reconstructs our database, supplies an ongoing feed of our offers or updates, or otherwise conflicts with its normal exploitation or unreasonably harms our legitimate interests;
• use bulk or systematically collected material from the Service to build, populate, update, or operate another deal website, price-comparison tool, alert service, commercial publication, or data product, including by reformatting the material or replacing our affiliate links;
• bypass login requirements, account-tier restrictions, CAPTCHAs, rate limits, or access blocks, including by using multiple accounts, rotating IP addresses, proxies, or third-party collection services to evade those controls; or
• harvest member profiles, contact details, or activity data for unsolicited marketing, profiling, or resale.

Subject to the exceptions below, these are contractual conditions of access and use, where enforceable; they do not depend on each individual record being protected by copyright. They cover both manual and automated activity through our pages, search results, and any feeds, downloads, or technical interfaces we provide. An interface being publicly accessible does not by itself grant permission for bulk extraction or commercial republication. Account access likewise does not grant a license to redistribute members-only content.

Ordinary use and authorized access. You may browse with ordinary browsers and accessibility tools, save individual deals for personal use, and share links to public pages with brief attributed excerpts. This permission does not extend to systematically republishing our listings or redistributing members-only content. Public search engines may crawl public pages to index them and display links with reasonable previews, subject to our applicable crawler instructions and access limits. Approved integrations may operate within the scope of their authorization.

Text and data mining. To the extent we hold the relevant rights, we expressly reserve the use of our protected content and databases for text and data mining under Article 4(3) of Directive (EU) 2019/790 and its implementing laws. This includes uses for training AI models. Such uses require our permission unless an applicable legal exception permits them.

Legal exceptions. Nothing in this section restricts lawful independent collection of information from retailers or other sources, lawful use of insubstantial database portions where that right cannot be excluded, or other uses protected by non-waivable legal exceptions, including applicable quotation, fair-use, accessibility, and scientific-research rights. Ordinary sharing under the permission above remains allowed.

Enforcement. We may apply proportionate technical restrictions and suspend or terminate access for violations, subject to section 10 and applicable law. Where legally available, we may seek court orders to stop unlawful extraction or reuse and claim compensation for resulting loss. Permission requests may be sent to admin@smoking-hub.com.

Other misuse and affiliate fraud. Do not gain unauthorized access to our systems, disrupt the Service, or interfere with its security or operation.

Do not use cookie stuffing, deceptive redirects, attribution hijacking, or other fraudulent methods to divert affiliate commissions.

Choosing to reject tracking, use privacy tools or an ad blocker, or visit a retailer directly is not affiliate fraud and is not prohibited by these Terms.

16. Copyright and Takedown Requests

Smoking Marketing Ltd., operating Smoking Hub and Cigar Deal Hunters, respects copyright and expects members to do the same. Our Service includes editorial content and user contributions, including posts, comments, images, screenshots, and deal submissions.

You must have the necessary rights, permission, or other lawful basis to submit material. A source credit or the fact that something is publicly available does not, by itself, authorize copying.

If you believe material on our Service infringes copyright, email admin@smoking-hub.com with:

1. Your name and email address.
2. A description of the copyrighted work, with a link to the original or other supporting information where available.
3. The exact URL or location of the material on our Service.
4. An explanation of why you believe the use is unauthorized, and your relationship to the copyright owner. If you are acting on the owner’s behalf, explain your authority to do so.
5. Confirmation that your report is accurate to the best of your knowledge and submitted in good faith.

We review reports promptly and may request clarification or supporting information. Where appropriate, we will remove or disable access to the material without undue delay. We may temporarily restrict access while reviewing a report and will take any action required by applicable law.

We may notify the person who submitted the material and give them an opportunity to respond. If you believe your content was removed in error, contact admin@smoking-hub.com with the relevant details and any evidence of permission or another lawful basis for its use. We will review your explanation and take appropriate action.

We may restrict, suspend, or terminate accounts for repeated or serious copyright violations, taking account of the circumstances. Do not use copyright reports to suppress lawful criticism or submit knowingly false claims.

We handle personal information in reports according to our Privacy Policy. Relevant information may be shared with the affected contributor or other parties only where necessary and lawful to investigate or resolve the matter. Please avoid including unrelated sensitive information.

This procedure does not limit any rights, remedies, or obligations under applicable law.

17. Privacy and feedback

Our Privacy Policy explains account information, public activity, tracking, communications, retention, and privacy rights. Consent to optional processing is obtained separately where required and may be withdrawn.

If you voluntarily send a nonconfidential suggestion about the Service, you allow us to consider and implement it without compensation. This does not transfer ownership of unrelated work, waive privacy rights, or permit disclosure of confidential information.

18. Health information

Tobacco use presents serious health risks and nicotine is addictive. Discussion of tobacco, storage, product quality, or pairings is not medical advice or a claim that a product is safe. The Service is intended for eligible adults and is not intended to encourage nonsmokers to start using tobacco.

19. Availability and warranties

Subject to rights that cannot lawfully be excluded, the Service is provided “as is” and “as available.” We do not guarantee uninterrupted access, complete historical records, uninterrupted alerts, the accuracy of every member contribution, or a retailer’s performance.

Keep your own copy of any submission you need. We may change or discontinue features for legitimate reasons, with notice where reasonably practicable and legally required.

20. Liability

To the extent permitted by applicable law, we are not liable for indirect or consequential loss, loss of business profits, or losses caused solely by a third-party retailer, another member, or circumstances outside our reasonable control.

Where a contractual cap is lawful and enforceable, our aggregate liability arising from the Service is limited to the greater of EUR 50 or the amount you paid us for the Service in the 12 months before the event giving rise to the claim.

These exclusions and the cap do not apply to fraud, intentional wrongdoing, gross negligence, death or personal injury for which liability cannot be excluded, or any other liability or remedy that applicable law does not permit us to exclude or limit. Mandatory consumer and data-protection rights remain unaffected.

21. Business users’ responsibility for third-party claims

If you use the Service on behalf of a business, and to the extent permitted by law, that business will indemnify us for reasonable third-party claims and costs directly caused by its unlawful content or culpable material breach of these Terms. This does not cover loss attributable to our own unlawful conduct. We will give appropriate notice and a reasonable opportunity to participate in the defense; we will not impose an admission or settlement obligation without appropriate agreement.

This business-user clause does not impose a general indemnity obligation on consumers.

22. Closing accounts and changing these Terms

You may stop using the Service or request account closure at admin@smoking-hub.com. Content and personal data are handled as explained in these Terms and the Privacy Policy.

We may suspend access immediately where reasonably necessary for a serious violation, security concern, or legal requirement. Otherwise, we will use proportionate measures and provide notice or an opportunity to correct an issue where appropriate.

We may update these Terms for changes to the Service or applicable requirements. Material changes will be notified through an appropriate channel before taking effect where required. We will seek renewed agreement where the law requires it. Changes do not retrospectively change completed promotions or remove mandatory rights. Continued use of the Service is not consent to new optional processing of personal data.

23. Governing law and disputes

These Terms are governed by Bulgarian law, without depriving consumers of mandatory protections available under applicable law. Disputes may be brought before the competent Bulgarian courts, except where applicable law gives a consumer or other person a right to another court or forum.

Nothing in this section prevents complaints to a competent regulator.

24. Other provisions

Additional published rules govern the features or promotions to which they specifically relate. If there is a conflict, specific promotion rules govern that promotion, section 16 governs copyright notice procedures, and the Privacy Policy governs descriptions of personal-data handling, always subject to applicable law.

If part of these Terms is unenforceable, the remaining provisions continue to the extent permitted by law. Failure to enforce a provision on one occasion does not waive future enforcement. A lawful transfer of the Service to a successor does not remove users’ mandatory rights or our applicable notice obligations.
